PRIVACY POLICY and TERMS OF USE

PRIVACY POLICY

Marker Advisors, LLC ("Marker Advisors," "we," "us," or "our") is a cybersecurity channel research firm operating the Marker Global research platform at notes.markerglobal.com, including the Marker Global MCP connector, which provides authenticated access to our published research notes through Model Context Protocol-compatible AI assistants such as Claude and ChatGPT.

This Privacy Policy explains what information we collect, how we use it, who we share it with, and how long we keep it. It applies to all users who authenticate with the Marker Global MCP connector.

1. Who we are

Marker Advisors, LLC is a cybersecurity channel research firm registered in the State of Arizona, United States. Our research is distributed exclusively to active subscribers under individual subscription agreements.

2. Information we collect

When you authenticate with the Marker Global MCP connector, we collect:

Account identity information - Provided through Auth0 during the OAuth authentication flow. This includes your email address and a unique user identifier issued by Auth0. We use this to associate connector activity with your active Marker Advisors subscription.

API key metadata (where applicable) - For subscribers who access the MCP via API key rather than OAuth, we store a SHA-256 hash of your API key, the date it was created, the date it was last used, and a revocation status. We do not store plaintext API keys.

Connector activity - Each call to the MCP server is logged at the infrastructure layer by our hosting providers (described below). This includes the request timestamp, request path, IP address, and user agent. We do not log the content of your queries, the research notes you retrieve, or any AI assistant conversations.

We do not collect financial information, browsing history outside the connector, location data, biometric data, or any special-category personal information through the MCP connector.

3. How we use your information

We use the information we collect to:

Authenticate your access to the Marker Global MCP connector and verify your subscription is active
Operate, maintain, and secure the service
Investigate and respond to security incidents, abuse, or unauthorized access
Comply with our legal obligations

We do not use your information for advertising, marketing profiling, AI model training, or sale to third parties.

4. Third-party service providers

We rely on a small number of third-party service providers to operate the Marker Global MCP connector. Each is contractually bound to handle data on our behalf:

Auth0 (Okta, Inc.) - Identity and authentication. Auth0 processes your email and authentication metadata. See Okta’s privacy policy at okta.com/privacy.

Supabase, Inc. - Database hosting for subscriber records, API key hashes, and research notes. See Supabase’s privacy policy at supabase.com/privacy.

Cloudflare, Inc. - Edge hosting for the Marker Global MCP endpoint, including default request-level logs as described in Section 2. See Cloudflare’s privacy policy at cloudflare.com/privacypolicy.

We do not share your information with any other third parties except as required by law.

5. Data retention

Account identity information is retained for as long as your subscription is active, plus up to 12 months after termination to support reactivation, billing reconciliation, and recordkeeping.
API key metadata is retained until the key is revoked, plus up to 12 months thereafter for audit purposes.
Connector activity logs held by our hosting providers are retained according to those providers' default retention policies, typically not exceeding 30 days.

6. Security

We protect your information with industry-standard safeguards, including TLS encryption in transit, encryption at rest in Supabase, OAuth 2.0 with RS256-signed JWTs validated against Auth0’s JWKS, and SHA-256 hashing of API keys. The MCP server runs read-only and cannot modify subscriber data or research content.

7. Your rights

Depending on your jurisdiction, you may have the right to access, correct, delete, or export your personal information, and to object to or restrict certain uses. To exercise any of these rights, contact us at privacy@markeradvisors.com. We will respond within 30 days.

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect about you and the right to request deletion. We do not sell personal information.

If you are in the European Economic Area or the United Kingdom, you have rights under the General Data Protection Regulation (GDPR), including the rights listed above and the right to lodge a complaint with your local data protection authority. Marker Advisors processes your data on the legal basis of contractual necessity to provide the subscription service you have agreed to.

8. Children’s privacy

The Marker Global MCP connector is intended for institutional investment professionals and is not directed at children under 18. We do not knowingly collect information from children.

9. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top. Material changes will be communicated to active subscribers by email.

These Terms of Use ("Terms") govern your access to the Marker Global research platform, including the Marker Global MCP connector ("the Service"), operated by Marker Advisors, LLC ("Marker Advisors," "we," "us," or "our"). By accessing the Service, you agree to these Terms.

1. Eligibility and access

Access to the Service is limited to active subscribers under an individual or institutional subscription agreement with Marker Advisors. You may access the Service only with credentials we have issued to you, and you are responsible for safeguarding those credentials. Sharing credentials, accessing the Service on behalf of any party not covered by your subscription, or using credentials after your subscription ends is prohibited.

2. Permitted use

You may use the Service to access, read, and analyze Marker Advisors research notes for your own internal investment research purposes. You may quote or reference findings from the research within your firm's internal investment process.

3. Prohibited use

You may not:

Redistribute, republish, resell, syndicate, or otherwise share Marker Advisors research with any person or entity outside your subscription
Unless explicitly granted, use the Service to train, fine-tune, or improve any machine learning model
Scrape, harvest, or systematically extract content from the Service beyond the queries supported by the official tools
Reverse-engineer the Service, its APIs, or its authentication mechanisms
Use the Service for any unlawful purpose or in violation of any applicable securities laws or regulations
Attempt to access content or accounts that are not yours

4. Confidentiality

Marker Advisors research is confidential and proprietary. Unless otherwise indicated, content delivered through the Service is intended only for the personal and confidential use of Marker Advisors subscribers. If you receive Marker Advisors content in error, you are notified that any review, dissemination, distribution, or copying of that content is strictly prohibited; please notify the sender.

5. Securities compliance

Marker Advisors provides research concerning private and publicly traded companies. To ensure compliance with federal securities laws and Marker Advisors' policies, nothing in the Service or in any communication with Marker Advisors is intended to request or solicit the disclosure or communication of any material non-public information, any proprietary data, or any information subject to any duty of confidentiality or non-disclosure concerning any business or entity.

6. Not investment advice

Marker Advisors research is provided for informational purposes only and does not constitute investment advice, a recommendation to buy or sell any security, or an offer to provide investment advisory services. You are solely responsible for your investment decisions.

7. Intellectual property

All content available through the Service, including research notes, summaries, and analytical commentary, is the intellectual property of Marker Advisors, LLC. Your subscription grants you a limited, revocable, non-transferable license to access and use the content as described in Section 2. No other rights are granted.

8. Service availability and accuracy

The Service is provided "as is" and "as available." Marker Advisors makes no warranties, express or implied, regarding the accuracy, completeness, timeliness, or fitness for any particular purpose of the content or the Service. Marker Advisors does not guarantee uninterrupted access and may modify, suspend, or discontinue any part of the Service at any time.

9. Limitation of liability

To the maximum extent permitted by law, Marker Advisors, LLC, its officers, employees, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including but not limited to investment losses, lost profits, or business interruption.

10. Termination

Marker Advisors may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason. Upon termination, you must cease all use of the Service. Sections 4, 5, 6, 7, 8, 9, and 11 survive termination.

11. Governing law

Unless explicitly agreed upon in our consulting agreement, these Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Arizona.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated to active subscribers by email. Continued use of the Service after changes take effect constitutes acceptance.
